If Your Grandparent Was British, You May Already Be Entitled to Citizenship

British citizenship by descent is a legal right, not an application in the traditional sense. If you have a British grandparent born in the UK, you may be entitled to register as a British citizen under Section 4D of the British Nationality Act 1981. This route was clarified and expanded in 2022, and the number of Americans applying has increased 42% year-on-year.

This is not the Ancestry Visa. The Ancestry Visa is a Commonwealth route — Americans do not qualify. The citizenship by descent route is completely separate, and it results in a full British passport, not a temporary visa.

Who Qualifies Under Section 4D

The eligibility rules under Section 4D are specific. You need to demonstrate:

  • A British grandparent born in the UK (England, Scotland, Wales, Northern Ireland)
  • Your parent was born outside the UK (which is why British citizenship was not automatically passed down)
  • You are the grandchild of that British national — the connection must be direct
  • Good character requirement — no serious criminal history

What Documents You Need

  • Your grandparent's UK birth certificate
  • Your parent's birth certificate
  • Your own birth certificate
  • Your US passport
  • Evidence of good character (police checks)

Americans with Irish, Scottish, or Welsh Heritage

Ireland has its own citizenship by descent route, which is completely separate from UK law. If your heritage is specifically Irish, we can advise on the Irish citizenship route as well.

Scottish and Welsh heritage qualifies for UK citizenship by descent in exactly the same way as English heritage — Scotland and Wales are part of the United Kingdom.
